Welcome to the Terms and Conditions of BotaniqueVase. Here you will find important information about our services, payments, deliveries, and more. We strive for transparency and a smooth shopping experience for all our customers

Applicability

These Terms and Conditions apply to all orders, offers, and agreements made through the BotaniqueVase webshop. By placing an order, the customer agrees to these Terms and Conditions. Deviations from these Terms and Conditions are only valid if agreed upon in writing.

Products and offers

 

  • BotaniqueVase sells vases with (decorative) flowers. Product images and descriptions are as accurate as possible, but may slightly differ from the actual product. The items shown in the vase are for illustrative purposes only. They are not included with the vase.

 

Prices and payments

All prices are stated in euros and include VAT, unless otherwise stated. Payment is processed through the payment methods offered in the webshop. BotaniqueVase reserves the right to change prices and offers at any time

Applicable law

 

  • All agreements shall be governed by Dutch law. Any disputes shall be submitted to the competent court in the Netherlands

 

Delivery and Shipping

BotaniqueVase strives to dispatch orders within the indicated delivery time. Delivery takes place at the address provided by the customer. Delays caused by the delivery service are beyond the control of BotaniqueVase. The risk of damage or loss transfers to the customer upon delivery.

Returning and complaints

Consumers are entitled to a statutory right of withdrawal of 14 days, unless the product has been personalised or made to order based on the customer’s chosen flowers, colours, or composition. No right of withdrawal applies to such personalised products.

BotaniqueVase informs the customer clearly before completing the order whether a product is personalised and therefore excluded from the right of withdrawal. ConsuWijzer states that sellers must properly inform consumers in advance about the cooling-off period and any applicable exceptions.

If a delivered product is damaged, incomplete, or not in accordance with the order, the customer must report this within 48 hours of delivery by email, including clear photos and a description of the issue.

If a complaint is found to be valid, BotaniqueVase will provide an appropriate solution. This may include replacement, repair, or refund, depending on the situation.

For business orders, statutory consumer withdrawal rights do not apply. Returns or cancellations for business purchases are only possible if BotaniqueVase has given prior written consent.

If a non-personalised consumer product is eligible for withdrawal, it must be returned unused and, where reasonably possible, in its original condition and packaging. The direct costs of return shipping are in that case borne by the customer, unless otherwise agreed.

Liability and Force Majeure

BotaniqueVase shall not be liable for indirect damages, including consequential loss or loss of profit. Liability is limited to the purchase price of the product.

In the event of force majeure (including, but not limited to, transport disruptions, adverse weather conditions, or technical failures), BotaniqueVase reserves the right to postpone or cancel delivery without any obligation to compensate damages.

Privacy and Data Protection

BotaniqueVase processes personal data exclusively for order processing and communication purposes. Personal data is handled in accordance with applicable privacy legislation (GDPR) and is not disclosed to third parties without prior consent.
